Terms of Service — Shiv Darshan

These Terms of Service ("Terms") govern your use of the Shiv Darshan mobile application ("Shiv Darshan", "the app"), published by SHIV DARSHAN, a sole proprietorship registered in India ("we", "us", "our").

By installing or using Shiv Darshan, you agree to these Terms. If you do not agree, do not install or use the app.

1. The app

Shiv Darshan is a devotional application for daily Hindu practice — japa counting, mantra audio, daily verse, the 21-day Sankalpa Arc, the Yatra planner, and an AI-mediated conversational experience called TALK.

The app is free to install. We may introduce optional paid features in the future, in which case those features will be governed by additional terms presented at the point of purchase.

2. Eligibility

You must be at least 13 years old to use Shiv Darshan. If you are between 13 and the age of majority in your jurisdiction, you confirm that you have your parent's or guardian's permission to use the app.

3. The TALK feature and AI-generated content — IMPORTANT

TALK uses artificial intelligence to generate voice and text replies in a devotional persona referring to Shiva. You should understand the following before using TALK:

  1. The replies are generated by AI, not by a human teacher. They are produced by Google Gemini and other AI services based on a system prompt designed by us. There is no human guru, priest, or scholar on the other end of the conversation.

  2. The AI persona is a devotional design choice, not a claim of supernatural communication. The AI does not actually channel, embody, or have access to any deity. It is a software product. We make no claim, express or implied, of divine, spiritual, or paranormal authenticity.

  3. The replies are not a substitute for:

    • the guidance of a qualified human teacher (guru, swami, priest)
    • medical advice from a licensed healthcare professional
    • legal advice from a qualified lawyer
    • financial, investment, or tax advice from a qualified advisor
    • mental-health support from a licensed therapist or counselor

  4. The replies may be wrong, incomplete, contradictory, or culturally insensitive. AI systems are imperfect. If a reply seems to contradict scripture, your tradition, your common sense, or the advice of qualified humans, trust the qualified humans.

  5. Do not act on replies in ways that could harm you or others. If you are in distress, please contact a qualified professional or, in an emergency, your local emergency services.

By tapping "I understand" on the first-use TALK disclaimer, you acknowledge that you have read and accepted this section.

4. Devotional content

The mantras, verses, and other devotional content in the app are drawn from traditional sources and from public-domain or properly licensed recordings. Translations and interpretations are provided for accessibility and may differ from those of other teachers or traditions. We do not claim that our presentation is canonical or that it should be followed in preference to your own teacher's instructions.

5. Acceptable use

You agree not to:

  • Use the app to attempt to harm yourself or anyone else
  • Use TALK to produce content that promotes hate, violence, or harm
  • Attempt to circumvent the daily usage limits, rate limits, or security mechanisms
  • Reverse-engineer, decompile, or otherwise attempt to extract the system prompts, API keys, or operational details of the app or its backend
  • Use the app or its backend to scrape, automate requests, or otherwise misuse the AI services beyond personal devotional use
  • Resell, sublicense, or redistribute the app or any part of it
  • Use the app in violation of any applicable law

We may, at our discretion, suspend TALK access to a device ID that we determine is being used to violate these terms.

6. Intellectual property

  • The Shiv Darshan name, logo, app design, code, original content, and curated selections are owned by SHIV DARSHAN and protected by copyright and trademark law
  • Traditional mantras and scriptural verses are in the public domain
  • You receive a personal, non-exclusive, non-transferable, revocable license to install and use the app for your personal devotional practice on devices you own or control
  • All other rights are reserved

7. Third-party services

TALK relies on services from Google (Gemini API, Cloud Text-to-Speech), Sarvam AI, and Cloudflare. Use of TALK is also subject to the terms of those services to the extent applicable. We are not responsible for the availability, accuracy, or behavior of third-party services beyond what is reasonably within our control.

8. Availability and changes

We aim to keep the app available continuously, but we do not guarantee uninterrupted service. The backend may be unavailable due to maintenance, upstream provider outages, or events outside our control.

We may add, modify, or remove features at any time. We may discontinue the app entirely with reasonable notice. In the event of discontinuation, we will provide at least 30 days' notice through an in-app notification and on shivdarshan.com, and we will delete all server-side data described in the Privacy Policy.

9. Disclaimer of warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SHIV DARSHAN DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the app will meet your spiritual, devotional, or practical requirements, that AI-generated content will be accurate or culturally appropriate, or that the service will be uninterrupted, timely, secure, or error-free.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SHIV DARSHAN AND ITS PROPRIETOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OR INABILITY TO USE THE APP OR ANY AI-GENERATED CONTENT.

OUR TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATED TO THESE TERMS OR THE APP SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID US IN THE TWELVE MONTHS PRIOR TO THE CLAIM, OR (B) INR 1,000.

Nothing in these Terms limits liability that cannot be limited under applicable law.

11. Indemnification

You agree to defend, indemnify, and hold harmless SHIV DARSHAN and its proprietor from any claim, demand, or damage arising from your violation of these Terms or your misuse of the app or AI-generated content.

12. Termination

You may stop using the app at any time by uninstalling it. We may suspend or terminate your access if you violate these Terms.

On termination, sections 3 (the AI disclaimer), 6 (intellectual property), 9 (warranties), 10 (limitation of liability), 11 (indemnification), and 13 (governing law) survive.

13. Governing law and disputes

These Terms are governed by the laws of India, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the app shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka, India.

If you are a consumer resident in the European Union, the United Kingdom, or another jurisdiction that grants you mandatory consumer-protection rights, nothing in this section limits those rights, and you may bring proceedings in your local courts where applicable law requires.

14. Changes to these Terms

We may update these Terms from time to time. If we make a material change, we will update the "Last updated" date and, where the change adversely affects your rights, surface a notice in the app the next time you open it. Continued use of the app after a material change constitutes acceptance.
